MAGNUM “DESIGN YOUR PLEASURE” GLOBAL TIKTOK COMPETITION

 

Terms and Conditions

 

These Terms and Conditions govern the Magnum “Design Your Pleasure” Global TikTok Competition (“the Competition”). By entering, you agree to be bound by these Terms and Conditions and the country-specific schedules. If there is a conflict between the General Terms and a country schedule, the country schedule prevails for entrants residing in that country.

 

1. Promoter and Contact

The promoter is the local Magnum entity referred to in the respective country schedules (“the Promoter”). 

 

2. Overview and Nature of Competition

The Competition invites users to style a fashion look inspired by their favourite Magnum as part of the build-up to the House of Magnum Fashion Show in Cannes, France. This is a skill-based competition and not a lottery. The prize is attendance at Magnum’s own event. The Competition, any submissions and all associated materials may not reference “Cannes Film Festival,” “Festival de Cannes,” “Official Selection,” “Red Carpet,” or any protected or similar terms either related to Cannes Film Festival or any other event of a similar nature. Doing so may disqualify the participants from this competition.

 

3. Eligibility

3.1 General eligibility : The Competition is open to residents aged 18 years or over of the United Kingdom, United States, France, Germany, the Netherlands, Italy and Spain (each an Eligible Country) (“Entrants”), excluding employees, contractors, and agents of the Promoter and their immediate families and households, and anyone professionally connected with the Competition.

3.2 Anyone worldwide may participate in the styling challenge, but only entries from the Eligible Countries can win (also “Entrants”)

3.3 Entrants may either style themselves or any other person above the age of 18 years from whom they have obtained explicit consent or permission to use their name and/or likeness in the manner contemplated by this promotion.

3.4 Social media: Entrants must hold a public TikTok account and be the authorised account holder for the username used to enter.

3.5 Country-specific eligibility and legal requirements apply as set out in the Schedules.

 

4. How to Enter

4.1 To enter, during the Entry Period, entrants must: 

(a) create and post on TikTok an original video styling an outfit inspired by a Magnum flavour; 

(b) tag @Magnum; 

(c) include the hashtag #MagnumCannes; and #Competition

(d) have a public TikTok account and accept these Terms and Conditions via the link on the landing page.

4.2 Entry is free and no purchase is necessary.

4.3Entrants may post multiple videos from their TikTok accounts. Reposts, duets or stitches of other creators’ content without original styling will not be considered valid entries.

4.4 Entries must be posted during the Entry Period defined at clause 13. Late, incomplete, ineligible, or non-compliant entries will be disqualified.

4.5 The landing page at https://magnumicecream.com/cannescompetition  will host these Terms and Conditions, eligibility criteria, judging criteria, prize description, and data and contact information. 

 

5. Content Standards and Intellectual Property

5.1 Originality and rights: Entries must be original to the entrant, created specifically for the Competition, and must not infringe any third-party rights including copyright, trademarks, designs, rights of publicity or privacy, or other intellectual property. 

5.2 Prohibited content: Entries must not include unlawful, defamatory, obscene, hateful, discriminatory, or otherwise objectionable content; must not depict or encourage unsafe behaviour; and must not include any third-party branding, logos, or music without appropriate licences. Entrants must not reference or depict the Cannes Film Festival or use any related and/or protected festival marks or imagery.

5.3 Licensing of entry content: By entering, you grant the Promoter a worldwide, non-exclusive, transferable, sub-licensable, royalty-free licence to use, reproduce, edit, adapt, publish, translate, create derivative works from, distribute, publicly perform and display your entry (including TikTok handle and likeness) in all media for perpetuity for the purposes of administering and promoting the Competition, the Magnum brand, and related events. Entrants consent to reasonable editing, cropping, and modification for format and compliance.

5.4 Name/likeness permissions: Winners and finalists agree to participate in reasonable publicity and grant the Promoter the right to use their name, image, voice, and biographical information for prize fulfilment and promotional purposes without further payment, except where prohibited by law.

5.5 TikTok policies: Entries must comply with the TikTok Terms of Service and Community Guidelines. The Competition is not sponsored, endorsed, administered by, or associated with TikTok. Entrants release TikTok from any claims arising out of or in connection with the Competition.

 

6. Judging and Winner Selection

6.1 The Promoter will internally review entries, select five finalists, conduct vetting calls, and then manually select the winner from the vetted shortlist based on a skill-based evaluation. All entries received by the closing date will be reviewed by an expert panel under the supervision of an independent judge.

6.2 Judging criteria: Entries will be judged on the following non-exhaustive criteria: creativity and originality; interpretation of Magnum-inspired styling; craft, presentation, and fashion relevance; and overall impact. Weightings may be applied at the Promoter’s discretion for clarity and fairness.

6.3 Tie-breaking: In the event of a tie, the entry with the higher creativity and originality score will prevail. 

6.4 Finality: The Promoter’s decisions are final and no correspondence regarding the Promoter’s decision will be entered into.

 

7. Winner Notification and Verification

7.1 The Promoter will contact the winner by direct message on TikTok and manage travel logistics through an agency. 

7.2 The winner must respond within 48 hours of notification, provide requested eligibility and identity information, complete any required consent and release forms, and pass vetting. Failure to comply, ineligibility, or inability to participate may result in forfeiture and selection of an alternate winner.

 

8. Prize

8.1 The prize is a hosted trip for the winner to Cannes, France, including: 

  • flights for two passengers; 
  • two nights’ accommodation in one hotel room at a 3* or 4* hotel selected by the Promoter with breakfast included; 
  • access to the Magnum Party;   
  • food and beverage consisting of hotel breakfast only. 
  • Local transportation within Cannes and airport transfers are not included.

8.2 Companion: The winner may nominate one companion aged 18+ who satisfies the same eligibility and travel requirements and must have exactly the same travel and stay plan as the winner. The winner is responsible for the companion’s compliance with these Terms.

8.3 Restrictions: The prize is non-transferable, non-exchangeable, and no cash alternative is available. Specifics of the prize may be subject to change at the sole discretion of the Promoters  

8.4 The Promoter reserves the right to provide alternative prizes of equal or greater value should circumstances outside Promoter's control make this necessary.

8.5 Travel conditions: Travel dates are fixed as set out in clause 13, subject to reasonable changes. The winner and companion are responsible for valid passports, visas, insurance, and compliance with health and entry requirements. Personal expenses, additional meals, gratuities, incidental charges, and transport not expressly stated are excluded.

8.4 Taxes and Social Charges: Winners are responsible for any applicable taxes and social charges, reporting obligations, or duties arising from receipt of the prize, except where local law requires the Promoter to account for or withhold such amounts.

 

9. Disqualification, Moderation, and Fraud Prevention

The Promoter may disqualify entries that are late, incomplete, ineligible, or non-compliant; that appear to involve vote farming, automated entries, bots, or manipulation; or that the Promoter reasonably believes to infringe third-party rights, contain prohibited content, or otherwise breach these Terms. The Promoter may remove, request removal of or report to TikTok any entry that breaches platform terms or these Terms.

 

10. Liability

The Promoter shall not be responsible for: 

(a) entries that are lost, delayed, misdirected, corrupted, or cannot be delivered for any reason beyond the Promoter’s reasonable control; 

(b) any disruption, cancellation, or alteration of the Competition due to events beyond its reasonable control; 

(c) any indirect, special, or consequential loss; or 

(d) any failure by TikTok or other third-party platforms or suppliers.

 

11. Indemnity

Participants shall indemnify and hold the Promoter and their respective affiliates, directors, agents, or other partners (""the Indemnitees"") harmless from any claims, actions, proceedings, costs (including reasonable legal fees) and expenses brought or asserted by a third party against any of the Indemnitees arising as a result of the Promoter's use of the entrant's submission including but not limited to any breach of third party intellectual property rights'

 

12. Data Protection and Privacy

The Promoter will process personal data of entrants for the purposes of administering the Competition, judging entries, verifying eligibility, communicating with entrants, publicising winners and finalists, and fulfilling the prize, on the basis of performance of a contract (these Terms) and the Promoter’s legitimate interests in running a fair and transparent promotion. Personal data may be shared with service providers and partners assisting with the Competition and prize fulfilment and may be transferred internationally, subject to appropriate safeguards in accordance with applicable data protection laws. Entrants have rights in relation to their personal data, including the right to access and correct their personal data, subject to applicable laws. Additional country-specific data terms may apply as set out in the Schedules.

 

13. Key Dates and Timeline

Competition period:  22 April 00:00 CET to 6 May 23:59 CET.

Winner travel dates: 13–15 May (House of Magnum events).

Specific dates within these windows will be confirmed on the landing page and may be adjusted for operational or legal reasons. All times and dates refer to Central European Time unless otherwise stated on the landing page.

 

14. Publicity of the Winner’s Name

The winner’s name, country, and TikTok handle may be published by the Promoter after winner verification for 90 days 

 

15. General

15.1 Governing law and jurisdiction: These General Terms are governed by the laws of England and Wales without prejudice to any mandatory laws of the entrant’s country of residence. 

15.2 Severability: If any provision is invalid or unenforceable, the remaining provisions remain in full force.

15.3 Variation and cancellation: The Promoter may amend these Terms for legal, regulatory, or operational reasons, and may suspend or cancel the Competition due to events beyond its reasonable control.

15.4 No waiver: Failure to enforce any provision shall not constitute a waiver.

15.5 Third-party rights: Except as expressly stated, no person other than the entrant and the Promoter has rights to enforce these Terms.

 

16. Platform and Third-Party Terms

Use of TikTok is subject to TikTok’s own terms and policies. The Promoter is not responsible for any changes to TikTok functionality or availability that may affect the Competition. 

This promotion is in no way sponsored, endorsed or administered by, or associated with TikTok. Entrants are providing information to the Promoter. Entrants release TikTok for all claims and liabilities arising in respect of the promotion.

 

17. Admission and Event Conduct

Admission to the Magnum Party is subject to venue capacity, entry conditions, age verification, and security protocols. The Promoter reserves the right to refuse admission or remove any person whose conduct is unsafe, unlawful, or disrupts the event, without liability.

 

18. Compliance, Transparency, and Best Practices

1. The Promoter will keep records of the promotion, including winner selection, for a reasonable period for compliance and audit purposes.

2. If you are selected as a winner and The Promotor receives a request from a consumer that a valid prize award took place, The Promotor will share the first letter or character of your TikTok with them, e.g. “@A”. If any regulatory or self-regulatory body request confirmation that a valid award took place, we will share your full username with them. This requirement shall also apply to clause 14 herein above.

 

19. In case of any conflict (including the content related information shared by the organizers externally on social media, website etc., these Terms shall prevail. 

 

20. Acceptance of Terms

Participation constitutes full and unconditional agreement to these Terms, which form a binding agreement between the entrant and the Promoter. In addition, by entering the competition, the entrants consent to the Promotor sharing the winners’ details with a third-party agency for the purpose of facilitating this promotion.

 

21. Country-Specific Schedules

The following schedules apply in addition to the General Terms for entrants resident in the specified country. In the event of conflict, the schedule prevails for that country.

 

Schedule A: United Kingdom

A1. Promoter: Magnum ICC UK Limited. 3 St James Road, Kingston Upon Thames, United Kingdom, KT1 2BA

A2. Data: For the purposes of any personal data processed in connection with the competition, the Promoter acts as a controller. Processing by the Promoter is subject to the UK GDPR and the Data Protection Act 2018. TikTok acts as a separate controller in relation to any personal data processed through the TikTok platform, in accordance with TikTok’s Terms of Service and Privacy Policy. 

 

Schedule B: United States

B1. Promoter: Magnum ICC US, LLC, d/b/a The Magnum Ice Cream Company. 800 Sylvan Avenue, Englewood Cliffs, NJ 07632

B1. Publicity: Where permitted by law, entrants grant rights to use name, likeness, and entry for advertising and publicity without further compensation. In Tennessee and other jurisdictions restricting publicity rights, such use will comply with local law.

B2. Disputes: For US entrants, these Terms are governed by the laws of the State of New Jersey. Class and representative actions are waived to the extent permitted by law.

B3. Privacy: US privacy disclosures, including CCPA where applicable, are available the link provided in Clause 12 above.  For the purposes of any personal data processed in connection with the competition, the Promoter acts as an independent controller (or “business,” as applicable under US privacy laws). The Promoter will process personal data in accordance with all applicable US federal and state privacy and consumer protection laws, including, where applicable, the California Consumer Privacy Act as amended by the California Privacy Rights Act (together, “CCPA/CPRA”), and other comparable state privacy laws.

B4. TikTok acts as a separate and independent controller (or “business”) in respect of any personal data processed through the TikTok platform, in accordance with TikTok’s Terms of Service and Privacy Policy. The Promoter is not responsible for any personal data processing carried out by TikTok.

 

Schedule C: France

C1. Promoter: Magnum ICC France SA LA DEFENSE / CB21 16 place de l'Iris 92400 COURBEVOIE, France

C2. Entrants confirm compliance with French consumer and promotional laws.

C3. Data:For the purposes of any personal data processed in connection with the competition, the Promoter acts as an independent controller. All processing carried out by the Promoter is subject to the General Data Protection Regulation (Regulation (EU) 2016/679) (“GDPR”) and applicable French data protection laws, including the Loi Informatique et Libertés.

C4. TikTok acts as a separate and independent controller in respect of any personal data processed via the TikTok platform, in accordance with its own Terms of Service and Privacy Policy. The Promoter is not responsible for any processing of personal data carried out by TikTok.

 

Schedule D: Germany

D1 Promoter: Die Promotion wird organisiert von der Magnum ICC Germany GmbH (nachfolgend „der Veranstalter“) mit Sitz in Neue Burg 1, 20457 Hamburg, die auch als Verantwortliche im Sinne des Datenschutzes für die Verarbeitung personenbezogener Daten fungiert.

D2. Data: For the purposes of any personal data processed in connection with the competition, the Promoter acts as an independent controller. All processing carried out by the Promoter complies with the GDPR and applicable German data protection laws, including the Federal Data Protection Act (Bundesdatenschutzgesetz - BDSG).

D3.TikTok acts as a separate and independent controller in respect of any personal data processed via the TikTok platform, in accordance with its Terms of Service and Privacy Policy. The Promoter bears no responsibility for TikTok’s processing of personal data.

D4. Consumer rights: Nothing in these Terms limits mandatory German consumer rights. Liability is limited to typical foreseeable damages for cardinal obligations. 

 

Schedule E: Netherlands

E1. Promoter: De promotie wordt georganiseerd door  Magnum ICC Netherlands B.V. (hierna “de Promotor”), met geregistreerd kantoor op Reguliersdwarsstraat 63, 1017 BK Amsterdam, tevens handelend als verantwoordelijke voor het verwerken van de persoonsgegevens.

E2. Data: For the purposes of any personal data processed in connection with the competition, the Promoter acts as an independent controller. Processing by the Promoter is conducted in accordance with the GDPR and applicable Dutch data protection laws, including the Uitvoeringswet AVG (UAVG).

E3. TikTok acts as an independent controller in relation to personal data processed through the TikTok platform, in accordance with TikTok’s Terms of Service and Privacy Policy. The Promoter does not influence and is not responsible for TikTok’s data processing activities.  

E4. Governing law: Dutch mandatory consumer protection rules apply to Dutch consumers in addition to the General Terms.

 

Schedule F: Spain

F1. Promoter:  La promoción está organizada por Magnum ICC Spain S.L.U. (en adelante, “el Organizador”), con domicilio social en Calle Tecnología 19, 08840 Viladecans (Barcelona), actuando también como responsable del tratamiento de los datos personales.

F2. Data:  For the purposes of any personal data processed in connection with the competition, the Promoter acts as an independent controller. All personal data processing by the Promoter is carried out in accordance with the GDPR and applicable Spanish data protection laws, including Organic Law 3/2018 on the Protection of Personal Data and the Guarantee of Digital Rights (LOPDGDD).

F3. TikTok acts as a separate and independent controller in respect of any personal data processed via the TikTok platform, in accordance with its Terms of Service and Privacy Policy. The Promoter is not responsible for TikTok’s processing of personal data. 

 

Schedule G: Italy

G1: Promoter: La Società promotrice MAGNUM ICC ITALY S.r.l., con sede legale in Roma - Via del Serafico, 200, C.F. 17989181007 promuove la seguente manifestazione a premi

G2. Data:  For the purposes of any personal data processed in connection with the competition, the Promoter acts as an independent controller. Processing by the Promoter is carried out in accordance with the GDPR and applicable Italian data protection laws, including Legislative Decree No. 196/2003 (Codice in materia di protezione dei dati personali), as amended.

G3. TikTok acts as a separate and independent controller in relation to any personal data processed through the TikTok platform, in accordance with TikTok’s Terms of Service and Privacy Policy. The Promoter has no control over and accepts no responsibility for TikTok’s processing activities.
